A Family of Four Changes Status Together: B-2 to F-1 and F-2 Approved

By Clarvo Legal · October 28, 2026

A family of four was visiting the United States when the mother was accepted into a full-time English language program. Instead of going home to apply for four visas, they changed status together: one Form I-539 for her move to F-1, with Form I-539A for her husband and two children as F-2 dependents. On August 12, 2026, USCIS approved all four on the same day.

Studying in the U.S. as a family

The family was visiting the United States when she decided to study English full time. She was accepted into a year-long English language program at a SEVP-certified school, and the school issued an I-20 for her, and one for each family member as her dependents.

Rather than return home and apply for four visas, the family asked to change status inside the United States, together.

How a family files together

A family change of status is built around one person. She filed Form I-539 as the principal applicant for F-1, and each family member was added on Form I-539A, the supplement for co-applicants. Because the forms travel together, USCIS reviews and decides them as one case.

  • One principal, three dependents. Her I-539 led the case, and each I-539A tied her husband and children to it.
  • Every relationship documented. Their marriage certificate and the children’s birth certificates proved each family tie.
  • Everyone in status. All four filed while their visitor status was still valid.
  • A clear commitment. She acknowledged that she would not begin classes until the change of status was approved.

What F-2 status means for the family

StudyThe children can attend school full time in the U.S. as F-2 dependents, from elementary through high school.
Stay togetherEach family member’s status is tied to hers, for as long as she keeps her F-1 status.
No workF-2 dependents cannot work in the United States, so the family’s funding has to cover everyone.

What made the difference

  • A single, coordinated filing. Four forms submitted together meant one decision for the whole family.
  • Complete family documents. Each relationship and each person’s status was proven from the start.
  • Filing while in status. The family was lawfully in the U.S. when the application was filed, and could remain while it was pending.

Visiting as a family and thinking about studying?

If you are in the United States as a visitor with your family and have been accepted to a U.S. school, your spouse and children may be able to change status with you as your dependents. File before everyone’s I-94 dates, and include each family member’s documents from the start.

Congratulations to this family on their new chapter.
