A current priority date means a visa number is available — it does not mean USCIS has the capacity to review your file. If you are wondering why your I-140 is still pending after 24 months despite your priority date being current, here is what is actually going on.
This is one of the most common questions I hear from petitioners, especially after the visa bulletin shows EB-2 as current.
The confusion is understandable. If my priority date is current, why is USCIS still sitting on my I-140 for up to 24 months?
Here is the distinction that matters.
Processing time and priority date currency are two entirely different things. Processing time reflects the file review backlog inside USCIS. Think of it this way — imagine an officer sitting at a desk with a thousand petition files stacked in front of them. If your file is number 1,001 in that queue, they have to work through all one thousand files before they even get to yours. That is processing time.
A current priority date, on the other hand, simply means that USCIS has an available visa quota to issue in your category. It tells you a visa number is available. It does not mean USCIS has the officer capacity to review and adjudicate your petition right now.
These two systems operate independently of each other — and that gap is exactly where the frustration lives.
This is also not unique to I-140s. There are several immigration benefit categories with no visa quota at all, yet they still carry significant processing delays simply because USCIS does not have the resources to keep up with the volume of applications being submitted.
A current priority date is good news. It means you are eligible. But eligibility and adjudication are not the same thing — and understanding that difference will save you a lot of anxiety while you wait.
