H.R. 1 Immigration Fees Rose Again on October 16: The FY2027 Amounts, the Math, and Who Pays

The H.R. 1 immigration fees went up for fiscal year 2027 on October 16, 2026: the parole fee is now $1,050, the annual fee on a pending asylum case is $105, and an initial asylum, parole or TPS work permit carries a $570 H.R. 1 fee. Here is every amount, why some did not move, and how to avoid a rejected filing.

H.R. 1 fees only. They are paid in addition to the regular USCIS filing fee for the form, which these notices do not change. FY2026 amounts applied from January 1, 2026 (USCIS fees); FY2027 amounts apply to filings postmarked on or after October 16, 2026.

What changed on October 16, 2026?

H.R. 1, the reconciliation law signed on July 4, 2025 (Public Law 119-21), created a set of immigration fees that sit on top of the ordinary USCIS filing fees. The statute also requires the Department of Homeland Security (DHS) to adjust them for inflation every fiscal year using the Consumer Price Index for All Urban Consumers (CPI-U), measured from one July to the next.

On October 1, 2026, DHS published two Federal Register notices for fiscal year (FY) 2027. The USCIS notice (91 FR 62540) covers asylum, work-permit, TPS and SIJ fees. A companion CBP notice (91 FR 62534) covers the parole fee and the I-94, ESTA and EVUS travel fees. According to the USCIS alert of September 30, 2026, any request postmarked on or after October 16, 2026 must include the new amount or it will be rejected.

Why did some H.R. 1 fees not change?

The answer is the rounding rule written into the statute. DHS applies the year's CPI-U change to the current fee, then rounds most fees down to the next lowest multiple of $10. The annual asylum fee and the I-94 fee round down to the nearest dollar instead. For FY2027 the CPI-U rose from 323.048 to 333.918, or 3.36%.

  • Initial asylum fee: $100 × 1.0336 = $103.36, which rounds down to $100. Under this method a $100 fee rounded to $10 can only rise in a year when inflation reaches 10%.
  • SIJ fee: $250 × 1.0336 = $258.41, which rounds down to $250. It needs a single-year increase of at least 4% to reach $260.
  • Renewal parole and TPS work permits: $280 × 1.0336 = $289.42, which rounds down to $280. Reaching $290 takes about 3.6% in one year.
  • Annual asylum fee: $102 × 1.0336 = $105.43, rounded to the dollar, which is $105. Because it rounds to the dollar, this fee moves almost every year.

The asylum-applicant renewal work permit ($275) is different: according to the USCIS notice, H.R. 1 does not provide for an inflation adjustment of that fee at all.

How far have the fees moved compared with prices?

Consumer prices (CPI-U) rose 6.2% from July 2024 to July 2026, the two years of adjustments so far. Because each step rounds down, every H.R. 1 fee has risen by less than that. The bars show the cumulative change since the FY2025 base amounts; the dark line marks the 6.2% CPI-U increase.

Who pays the new amounts?

People with a pending asylum case

The annual fee for a pending asylum application is $105. A first work permit while asylum is pending carries a $570 H.R. 1 fee; renewals stay at $275. See our explainer on the 180-day asylum EAD clock.

Parolees

The parole fee is $1,050, assessed by CBP, USCIS or ICE, unless DHS finds on an individual basis that an exception applies. An initial parole work permit is $570; renewal and re-parole permits are $280.

Temporary Protected Status applicants

A first-time TPS application carries a $520 H.R. 1 fee, and an initial TPS work permit $570, both on top of the regular form fees. Renewal TPS permits stay at $280.

Travelers

Visa Waiver Program travelers pay $40.62 for an approved ESTA. The EVUS H.R. 1 fee is $31.75. The I-94 H.R. 1 fee stays at $24.

What to do before you file

  1. Check the amount on the filing date, not the date you prepared the packet. The test is the postmark. Anything postmarked on or after October 16, 2026 needs the FY2027 amount.
  2. Pay the H.R. 1 fee as its own payment. The USCIS fee schedule (G-1055) says these fees must be paid separately from, and at the same time as, any filing fee.
  3. Do not count on a fee waiver. According to USCIS, H.R. 1 fees cannot be waived. You may still ask to waive the regular filing fee if you qualify, but the H.R. 1 fee must be paid.
  4. If a packet was rejected for the wrong fee, refile. A rejection is not a denial, but the new filing date is the date USCIS accepts the corrected packet, which can matter for deadlines such as TPS registration windows.
  5. Budget for next year. The fees will be recalculated from the July 2027 CPI-U. DHS has not announced FY2028 amounts, and it says it may later write the annual adjustments into its regulations at 8 CFR part 106.

Open questions

The notices settle the amounts but leave a few points open. DHS says it may codify the yearly adjustments in a future rule, so the mechanics could change. The parole-fee exceptions are decided case by case and are not listed in detail in the FY2027 notice. And the statute's round-down rule means small fees can stay frozen for years and then jump by $10 in a single high-inflation year, so do not rely on today's amount when you plan a filing months ahead.

Frequently asked questions

What are H.R. 1 immigration fees?

They are fees created by the One Big Beautiful Bill Act (H.R. 1, Public Law 119-21), signed July 4, 2025. They cover asylum applications, certain work permits, parole, TPS, SIJ petitions and some travel records. They are charged on top of the regular USCIS filing fee and must be adjusted for inflation every fiscal year.

When did the FY2027 H.R. 1 fees take effect?

On October 16, 2026. USCIS says any request postmarked on or after that date must include the new fee or it will be rejected. CBP began collecting the new parole, ESTA and EVUS amounts on the same date. The amounts were announced in Federal Register notices published October 1, 2026.

Which H.R. 1 fees did not change for FY2027?

The $100 initial asylum application fee, the $250 Special Immigrant Juvenile fee, the $280 renewal work permits for parole, TPS and re-parole, the $275 renewal work permit for asylum applicants and the $24 I-94 fee stayed the same. Most of these stayed flat because the law rounds inflation-adjusted amounts down.

Can I get a fee waiver for H.R. 1 fees?

No. USCIS states that the fees required by Public Law 119-21 cannot be waived. If you qualify, you may still request a waiver of the regular USCIS filing fee for the same form, but the H.R. 1 fee must be paid separately with the filing.

What happens if I send the old fee amount?

USCIS will reject a request postmarked on or after October 16, 2026 that does not include the correct FY2027 fee. A rejected filing is returned and is treated as never filed, so you would need to resubmit with the right payment, and your filing date becomes the date the corrected packet is accepted.

Will H.R. 1 fees go up again next year?

The law requires an adjustment every fiscal year based on the change in the CPI-U from July to July. Whether a given fee actually rises depends on that year's inflation and the round-down rule. DHS has not announced FY2028 amounts, so check the USCIS fee schedule before each filing.
