Work Permit — I-765 Employment Authorization Document

An Employment Authorization Document (EAD) issued on Form I-765 lets non-citizens work for any U.S. employer. Hasan Legal PC files I-765 applications for clients across the DMV — including pending I-485 applicants, asylum applicants, F-1 OPT and STEM-OPT students at Georgetown, GW, AU, UMD and Hopkins, TPS holders, DACA recipients, and L-2 / E / H-4 dependent spouses.

01

Who is eligible for an EAD

EAD eligibility is granted by category. The most common categories at our DMV practice include (c)(9) pending I-485 adjustment of status, (c)(8) pending asylum, (c)(33) DACA, (a)(12) Temporary Protected Status, (c)(3)(A)/(B)/(C) F-1 OPT and STEM OPT, (c)(26) H-4 spouses with an approved I-140 employer, and (a)(18) L-2 and (a)(17) E spouses (now automatically work-authorized incident to status).

02

Processing times in 2026

Standard I-765 EAD applications are processing in 3 to 5 months in 2026. EADs filed concurrently with I-485 are tied to the I-485 case. Renewal EADs filed timely (before the prior EAD expires) qualify for an automatic extension of up to 540 days under current USCIS rules — which is critical for asylum applicants and pending adjustment applicants in the DMV.

03

Filing fees

The standalone I-765 filing fee in 2026 is $520. When filed concurrently with a pending I-485 the fee is waived. Asylum applicants in category (c)(8) filing an initial EAD pay $0; renewal EADs in (c)(8) pay the full fee.

04

Premium processing for certain F-1 OPT and STEM OPT cases

Premium processing on Form I-907 is available for many I-765 categories including (c)(3)(A) initial OPT, (c)(3)(B) post-completion OPT, and (c)(3)(C) STEM OPT extensions. The premium processing fee for I-765 in 2026 is $1,685 for a 30-business-day decision.

05

Renewal strategy

USCIS recommends filing renewal EADs up to 180 days before the current card expires. For categories that qualify for the automatic 540-day extension, the receipt notice (Form I-797C) plus the expiring EAD serves as continuing work authorization. Always confirm Form I-9 documentation rules with your employer's HR department.

Frequently Asked Questions

Common eligible categories include pending I-485 adjustment-of-status applicants, pending asylum applicants, DACA recipients, TPS holders, F-1 students applying for OPT or STEM OPT, certain H-4 spouses, and L-2 and E spouses. Each category has its own eligibility rules and supporting evidence requirements.
How long does I-765 processing take in 2026?
I-765 EAD applications are processing in 3 to 5 months in 2026. When filed concurrently with I-485, the filing fee is waived and processing is tied to the I-485 case. Premium processing is available for many F-1 OPT categories at $1,685 for a 30-business-day decision.
When should I renew my EAD?
USCIS recommends filing your EAD renewal up to 180 days before your current EAD expires. For categories that qualify, a timely-filed renewal triggers an automatic extension of work authorization for up to 540 days based on the I-797C receipt notice plus the expiring EAD.
What is the I-765 filing fee in 2026?
The standalone I-765 filing fee in 2026 is $520. When filed concurrently with a pending I-485 the fee is waived. Asylum applicants filing an initial EAD in category (c)(8) pay $0.
Can my employer in DC, Virginia or Maryland hire me on the 540-day automatic extension?
Yes. For eligible categories, the I-797C receipt notice for a timely-filed renewal combined with the expired EAD serves as List C employment authorization for Form I-9 purposes for up to 540 days from the prior EAD expiration date. Confirm category eligibility with your immigration attorney.
Can I travel internationally with just an EAD?
No. An EAD authorizes employment but does not authorize re-entry to the United States. If you have a pending I-485 you must use Advance Parole (Form I-131). F-1 OPT students re-enter on a valid F-1 visa and OPT EAD with employer letter and Form I-20.
